Dangerous & Defective Products
Our firm represents people who have been seriously injured or killed by defective products. Products injure people because of faulty design or manufacture, and because they lack sufficient warnings or instructions. Product liability suits can exist independently, or in conjunction with other types of claims.
Product Liability Cases
Our firm is experienced in handling cases on behalf of consumers against large manufacturers. We have the resources and networking capabilities to retain superior experts who can go toe-to-toe with any industry. Product liability cases require more than experts, however, and we use the advantages of technology to educate the jury as to why the manufacturers of dangerous and defective products should be held liable. All too often, in today's world, products still have many of the dangers associated with the industrial revolution when profit was everything and human life was cheap. Forcefully reminding these companies that they must hold the highest regard for consumer safety in every product they intend to sell, is a job for experienced trial attorneys.
About Product Liability Law
Product liability law involves injuries caused by defective products that occur while the product is being used for its normal and intended operation. Thousands of injuries occur each year as a result of unsafe design, inadequate warnings and instructions, defective manufacturing and fraudulent marketing. When these injuries are severe and result in life altering injuries to the users of unsafe products, such as brain injury, spinal cord injury, burn injury, dismemberment or wrongful death, we help the injured person file suit for damages against the manufacturer of the dangerous product.
Strict Liability
Many state product liability laws apply the concept of strict liability in defective products cases. Strict liability means that the law does not consider whether a manufacturer, designer or marketer (i.e., the defendant) knew about a particular defect in a particular product. If an injury occurs, and the product is deemed unreasonably dangerous or unfit for its intended use, then some degree of negligence on the part of the defendant is presumed. The law holds the defendant liable for allowing the defective product to be placed in the stream of commerce. Strict liability is an important legal advantage for a person injured during the normal use of a defective product, and an advantage that is not afforded in most other areas of personal injury law. Strict liability is applied in product liability law for two important reasons:
|
• The first is that in almost every defective products case, the corporation or business responsible for a defective product has vastly greater resources than the injured person to make the product safer in the first place. Without strict liability, there would be little legal recourse for the average person injured by a defective product, and zero consequences for companies that allowed dangerous products into the market.
• The second reason for strict liability is simply this: there is no place in our society for aircraft, components, vehicles, and products in general that maim and kill. Companies are obliged to consider the complete safety of their products before releasing them for public consumption. On the scales of justice, the safety of the consumer always outweighs the profits and business concerns of the supplier. Whether that product is a new diet pill or a piece of construction equipment, the onus of providing for the safety of the product always rests squarely on the corporation(s) responsible for the product.

Product Injury Compensation
The plaintiff's biggest challenge in a product liability case, then, is to prove that the product was indeed defective and that the injury occurred during the normal use of the product. Given the broad range of products known to cause injury, it is important for injured victims of defective products to hire knowledgeable and experienced trial attorneys familiar with the many intricate steps involved in obtaining maximum compensation for injuries caused by defective products.
Defective product liability cases often involve a corporate defendant. It is essential for injured victims to be represented by a law firm with the financial resources and trial experience to effectively represent them against a defendant with deep pockets. Our products liability lawyers are dedicated to devoting all the resources necessary to successfully represent clients injured by defective products.
